Terms and conditions

  1. Booking details

1.1. It is the Client’s responsibility to ensure that all details given of the venue are correct and should Kend Vibes inspect the venue and find any inconsistencies this will be highlighted. In the spirit of fluency and good working relations we will find ways of amicably resolving the situation. If the inconsistencies are such that they make it difficult for the work to progress, this will be communicated in terms of liability. In this regard, it is also the client’s responsibility to indicate what access is available i.e, stairs, lifts, car parking etc.

1.2. The client will ensure that Kend Vibes are given adequate set up time, at least 90 minutes before the start time and 60 minutes after the event to give us ample time to pack our units.

1.3. The client and Kend Vibes confirm that there is no third party interest on the booking and no previous bookings of these dates for this event.

1.4. Confirmation of booking will only be sent out once a stipulated/agreed deposit has been paid. Kend Vibes reserves the right to negotiate other contracts which may invalidate verbal agreements for which a deposit has not yet been paid in full.

  1. Payments

2.1. Paying By Cheque: For cheque payments, they should be made payable to Kend Vibes. Could you also please write your surname and the date of your event on the back of the cheque for reference purposes.

2.2. Paying by Bank Transfer: Should you wish to pay by bank transfer you will be provided with the relevant bank details on request. For referencing purposes could you please include name or date of event.

2.3. All balances should be payed the day before or on the day of the event prior to work commencing. Failure to comply with this will be viewed as breach of agreement resulting in work not being undertaken and forfeiting of previously paid funds. In extreme cases Kend Vibes may seek compensation through litigation.

  1. Cancellations

3.1. Once a date has been booked, Kend Vibes will hold the date exclusively for you and will under no circumstances entertain other enquiries.  To protect ourselves from loss of income through cancellations  Kend Vibes will charge a cancellation fee and we state that all cancellations must be made either in writing or by e-mail. Telephone, text, whatsApp or any other social media cancellations will not be accepted.

3.2. Any cancellations effected within 30 days prior to the event will incur a cancellation fee of 50% of the outstanding balance. Cancellations before the 30 day mark will only result in the forfeiture of the deposits paid.

3.3. Should the event be cancelled due to exceptional circumstances deemed entirely beyond the clients control i.e death or critical illness, in the spirit of humanity, Kend Vibes will offer a full refund of any monies already paid.

3.4. If the DJ is too ill or becomes injured and cannot provide the services specified above, Kend Vibes will do everything possible to book a replacement. If a replacement DJ cannot be found in these circumstances, liability is limited to a refund of any payments received.

  1. Conduct

4.1. It is the client’s responsibility to ensure the safety and integrity of the DJ is maintained throughout the session. This involves avoiding over-crowding and use of foul/intimidating language towards the operator. It is strongly recommended that any communication with the operator is regulated via the mc or compere especially on making requests for songs to be played. In the event of abuse, foul and threatening behaviours, the operator reserves the right to terminate employment at short notice and if a criminal offence is deemed to have been committed the matter will be reported to the law enforcement authorities. Before such actions are undertaken the client will be given an opportunity to amicably resolve the matters with the guests in question.

4.2. The client will be responsible for providing adequate supervision of  guests, especially children and may be held liable for any loss of or damage to the Kend Vibes equipment or personal belongings, caused by guest(s).

4.4. Kend Vibes personnel promise to be professional in their conduct and approach at all times and will set up and run as requested by the client unless there are legal and Health and Safety issues to be put into consideration.

4.5. Kend Vibes will be responsible for producing certificates of Public Liability Insurance (PLI) and Portable Appliance Testing (P.A.T).

  1. Health and Safety

6.1. Kend Vibes will adhere to all rules and regulations of the HSE EAW Act 1989, to which the client must also adhere to. Failure to comply with the above Act, may result in Kend Vibes refusing to undertake the job as agreed but the client will still have to incur the full cost as charged. Forcing or coercing Kend Vibes personnel to work under these conditions or withholding payments may be reported to law enforcement authorities.

6.2. In the event of fire, flooding, public disturbance, terrorist activity or any other threat to the public, Kend Vibes will not be responsible for  evacuation but may take part in helping depending with the gravity of the situation and expressed need, both morally and legally.

  1. The Venue

7.1. The Client must ensure that there is adequate parking for Kend Vibes for both off-loading and loading of equipment and parking should comply with the regulations.

7.4. If the performance start time is delayed due to the inability of Kend Vibes to gain access to the performance area, or any other delay beyond Kend Vibes reasonable control, Kend Vibes will not be held responsible or liable.

7.5. If you are booking other entertainment (e.g. Singer, comedian, band etc) as well as hiring ourselves, could you please put into consideration the space available and the geographical location of all parties. For good quality sound output it recommended that the speakers are placed no greater than 10 metres either side from the position of the disc jockey. It also imperative that other entertainers provide their own sound and amplifying equipment. Only in very exceptional conditions will Kend Vibes allow their equipment to be used for any other purposes rather than prescribed in this agreement.

  1. Refreshments

8.1. The client agrees to provide a meal and refreshments for Kend Vibes personnel where the length of the event exceeds 3 hours.
